These terms explain how you can use our website, how our client services work, and how you buy our software products. We have kept them as plain as we can.
1. Who we are
This website and the KHD software products are operated by Khatib Designs Ltd (Хатиб Дизайнс ООД), a limited liability company registered in Sofia, Bulgaria, trading as “Khatib Designs” and “KHD”. When these terms say “we”, “us” or “KHD”, they mean Khatib Designs Ltd. When you use this site, hire us or buy one of our products, your contract is with Khatib Designs Ltd.

2. Accepting these terms
By using this website, signing a proposal with us, or buying one of our products, you agree to these terms. If you continue to use the site or a product after we update them, you accept the updated version. If you do not agree, please do not use the site or the product.
3. Client services (design, development and AI consulting)
Our consulting and project work — AI strategy, custom AI and software builds, mobile and web apps, design and support retainers — is always done under a written proposal, statement of work or contract that both sides sign. That document sets the scope, price, payment schedule, deliverables, acceptance, intellectual-property transfer and any refund terms for that engagement.
- If the signed contract and these terms disagree, the signed contract wins.
- Anything the contract does not cover falls back to these terms.
- Quotes and estimates on this site, in emails or on calls are indicative until they appear in a signed document.
4. KHD software products
We also build and sell our own software. Today these are:
- MODAX (modax.app) — a modular, AI-assisted CRM for businesses, with a free plan and paid per-user plans.
- Marj3 (marj3.app) — an Arabic-first report and monitoring service that shows whether AI assistants name your brand.
We will add new products over time. Each product has its own terms, privacy notice and refund policy on its own website, and those apply in addition to these terms. Prices are shown on each product’s pricing page before you buy.
5. Orders, payments and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
When you buy a KHD software product online, you buy it from Paddle, which resells it to you. Paddle’s Buyer Terms apply to the payment itself. Paddle calculates and collects any sales tax or VAT and shows the final price, including tax, before you pay.
- Subscriptions renew automatically at the end of each billing period (monthly unless the checkout says otherwise) at the price shown when you subscribed, until you cancel. We will tell you in advance before we change the price of an existing subscription.
- One-off purchases are charged once.
- Cancellation: you can cancel a subscription at any time from the product’s billing settings, from the link in your Paddle receipt, or by emailing us. You keep access until the end of the period you have already paid for, and you will not be charged again.
- Refunds follow our Refund Policy.
Client services under a signed contract are invoiced directly by Khatib Designs Ltd as set out in that contract, not through Paddle.
6. Acceptable use
You must not use our website, services or products to:
- break the law, or help anyone else break it;
- commit fraud, send spam or impersonate anyone;
- infringe anyone’s intellectual property or privacy;
- upload malware, probe or attack our systems, bypass security or usage limits, or scrape the site or products by automated means without our written permission;
- resell or sublicense a product unless its plan allows it.
7. AI features and outputs
Some of our work and products use generative AI. AI output can be wrong, incomplete or out of date. You are responsible for what you put in (and for having the right to use it) and for checking output before relying on it. Do not use AI output as legal, medical, financial or other regulated professional advice without qualified human review. We may remove content or suspend features that are used in breach of section 6.
8. Intellectual property
We own this website, our products, and the software, designs, text and brands in them, or we license them from their owners. Using them does not transfer any ownership to you. For client projects, ownership of deliverables passes to the client as set out in the signed contract, usually on full payment. You keep ownership of the data and content you put into our products.
If you believe something on our site or in our products infringes your rights, email studio@khatibdesigns.com with the details and we will look into it promptly.
9. Availability
We work hard to keep the site and products running, but we do not promise they will be uninterrupted or error-free. We may change, improve or withdraw features. If we withdraw a paid product entirely, we will give reasonable notice and refund any prepaid period you can no longer use.
10. Suspension and termination
We may suspend or end your access to a product if you materially breach these terms or a product’s terms, do not pay, create a security or fraud risk, or repeatedly or seriously break the rules in section 6. Where it is reasonable, we will warn you first and give you a chance to fix the problem. You can stop using a product at any time.
11. Liability
Nothing in these terms limits liability that cannot legally be limited, such as for fraud, or for death or personal injury caused by negligence. Otherwise, we are not liable for indirect or consequential losses, or for loss of profit, revenue or data, and our total liability to you for any claim about a product is limited to the amount you paid for that product in the 12 months before the claim. Liability for client services is set in the signed contract.
If you buy as a consumer, you also have the rights the law of your country gives you, and these terms do not take them away.
12. Governing law
These terms are governed by the laws of the Republic of Bulgaria, and the courts of Sofia have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in your local courts.
13. Changes
We may update these terms. The date at the top shows the latest version. For significant changes to a paid product we will tell customers by email or in the product before the change applies.
